Help Stop A Tax That Hurts Nonprofit Organizations
Urge Congress to end a tax penalty on nonprofits who provide their employees with transportation benefits, such as an office parking spot or transit passes.

The 2017 Tax Cuts and Jobs Act (P.L. 115-97) imposed a significant new tax on nonprofits for expenses they incur in providing their employees with transportation fringe benefits, such as parking and transit passes. This new, 21-percent unrelated business income tax (UBIT) could divert about $12,000 away from a nonprofit’s mission and core services to cover the tax and related compliance costs, according to a 2019 Independent Sector study.

Easterseals supports legislation (H.R.1545 and S. 632) introduced in Congress to end this unfair and harmful tax on nonprofits.

Contact your Members of Congress: Ask them to repeal the nonprofit transportation tax.

I am writing to express concern over a new tax on nonprofits that, if not repealed, would divert millions of dollars of resources currently used by nonprofits nationwide for core mission services and community supports.

The 2017 Tax Cuts and Jobs Act (P.L. 115-97) imposed a new, 21 percent unrelated business income tax on nonprofits for expenses they incur in providing their employees with transportation fringe benefits, such as parking and transit passes. According to a 2019 Independent Sector study, this new tax could cost every nonprofit nearly $12,000, on average, to cover the penalty and related compliance costs. This shift away from core mission services would be devastating for the communities and families served by nonprofits.
