On September 23, 2004, the House passed -- by a vote of 247 to 173 -- H.R. 2028, the Pledge Protection Act. This legislation removes jurisdiction from all federal courts, including the Supreme Court, over any constitutional claim involving the Pledge of Allegiance or its recitation. The ACLU opposed this legislation because it seriously violates the principles of separation of power, due process, and equal protection by denying citizens the right to have their religious and free speech claims heard by the federal courts.
