On February 13, the House passed H.R. 592, the "Federal Disaster Assistance Nonprofit Fairness Act of 2013,” by a vote of 354-72. The ACLU opposed the bill because it would change current law to mandate that FEMA provide grants of government funds to rebuild houses of worship after disasters. FEMA's current, longstanding policy does not permit houses of worship to receive reconstruction grants and both ensures that these grants are used to rebuild facilities that provide the most critical services to the entire community and reflects an important constitutional principle. One of the central aims of the First Amendment's Establishment Clause is to protect against taxpayer funding of religious worship or the buildings used primarily for worship. This principle is not discriminatory or hostile to religion. Rather, it is one of the most fundamental ways we have to protect and defend religious liberty for all. The bill was referred to the Senate for further action.
