On September 28, 2006, the Senate voted 48-51 to reject an amendment that would have removed a provision from the Military Commissions Act of 2006 (S. 3930) that retroactively stripped federal courts of authority to consider habeas corpus petitions and other legal actions by detainees. The ACLU supported the Specter Amendment (No. 5877) because it would have stricken a section that, using an extraordinarily broad definition of "enemy combatants," shuts federal courthouses to any claims by detainees of wrongful detention, actual innocence or torture and abuse.
