House Roll Call No. 238
112nd Congress, 2nd Session

Failed: 163-262 (see complete tally)
On Wednesday, May 9, the House rejected House Amendment 1084 to H.R. 5326, the Commerce, Justice, Science and Related Agencies Appropriations Act, 2013, by a vote of 163-262. This amendment, sponsored by Representative Rohrabacher (R-CA), Hinchey (D-NY), McClintock (R-CA), and Farr (D-CA) would have prohibited the Department of Justice from using federal funds to prevent the implementation of state laws authorizing the use of medical marijuana. The ACLU supported this amendment because it would protect states' ability to choose how to regulate medical marijuana without fear of federal interference.
