On May 14, the House rejected Rep. Adam Smith’s (D-WA) amendment number 16 to the FY 2016 National Defense Authorization Act (NDAA) by a vote of 174-249. The ACLU supported this amendment because it would have eliminated all of the provisions in the NDAA base bill that prohibit the transfer of cleared Guantanamo detainees and prevent the Secretary of Defense from closing the Guantanamo detention facility. The Smith amendment would have facilitated the closure of the Guantanamo detention facility and allowed the end of indefinite detention without charge or trial.
